Please read these terms carefully before using AI WFO or AI WFM.

1. Agreement to Terms

By accessing or using the AI WFO and/or AI WFM platforms ("Services") provided by TheMadHacker LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not access the Services.

2. Description of Services

We provide AI-native Workforce Optimization (AI WFO) and Workforce Management (AI WFM) software, including features such as efficiency analytics, bottleneck detection, training engines, AI agent tuning, scheduling, and related integrations. The specific features available to you depend on your chosen licensing tier and configuration.

3. Accounts & Registration

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate, current, and complete registration information.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Licensing & Payment

  • AI WFO and AI WFM are offered under a perpetual, one-time licensing model — no recurring subscription is required to continue using the Services.
  • Pricing, seat counts, and tiers are specified at the time of purchase or in a separate agreement.
  • Optional annual support plans are separately priced and never auto-renew without your explicit consent.
  • Taxes (excluding income taxes imposed on us) are additional and your responsibility.
  • Licenses are non-transferable except with our prior written consent.

5. Acceptable Use

You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to any system or data; (c) reverse engineer, decompile, or disassemble the Services except as permitted by law; (d) resell, sublicense, or distribute the Services without authorization; (e) use the Services to store or transmit malicious code; (f) interfere with the proper working of the Services.

6. Data & Confidentiality

  • You retain all right, title, and interest in your data submitted to the Services ("Customer Data").
  • We process Customer Data only to provide the Services and in accordance with our Privacy Policy.
  • We implement appropriate technical and organizational measures to protect Customer Data.
  • Business Associate Agreements (BAA) are available for regulated customers as applicable.

7. Intellectual Property

The Services, including but not limited to code, designs, trademarks, logos, and documentation, are the property of TheMadHacker LLC and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services per your licensing tier.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that results will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall TheMadHacker LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising out of or in connection with these Terms or the Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless TheMadHacker LLC from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your infringement of any third-party rights.

11. Term & Termination

These Terms remain in effect until terminated. You may terminate them by ceasing use of the Services. We may terminate or suspend access immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date and, where appropriate, by email. Continued use of the Services after modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.
